Details Cautionary Notice for Design Oman
Kindly be advised that presently there is no statutory Design Law in Oman in nforce. Therefore, it would not be possible to file design applications in Oman. However, in the absence of Design Law, Cautionary Notice(s) in leading newspapers in Oman for the said design may be published to declare owner's rights in the said design. The cost for publication of such Cautionary Notice(s) depends upon the total area covered by the same and therefore such cost may not be calculated before hand. No formal documents would be needed for the publication of cautionary notices.
However the Royal Decree 39/2000 regulates industrial drawings and patterns. In order to be protected, a drawing or pattern must be registered in the trade drawings and patterns register at the Ministry of Commerce and Industry in Oman. The person who created the drawing or pattern is then deemed to be the owner, unless another party can prove this not to be the case.
The maximum term of protection in Oman is 20 years provided the registration is renewed 1 time for a period of 10 years.
An industrial design must hjave novelty or originality. An industrial design which lacks novelty or originality or which was disclosed to the public in any country of the world by way of publication, use or in any other manner prior to the filing date of the application or, if any, priority date of a registration application may not be registered as industrial designs.
